Terms and Conditions - Homebody Studios

I. Application of These Terms and Conditions (the “Homebody Agreement”)

These Terms and Conditions (“Terms”) govern your relationship with Homebody Studios (“Homebody,” “we,” “us,” or “our”), including use of our studios, website, services, memberships, and products. By accessing or using any part of our services, including Pilates classes, events, and wellness offerings, you agree to these Terms. These Terms apply to all Homebody Studios locations, including:

  • Homebody Studios – Montecito: montecito@homebodystudios.co

Clients should contact their local studio for any membership, class, or account-related inquiries.

II. Arbitration Agreement and Class Action Waiver

A. Informal Dispute Resolution
Homebody aims to resolve issues promptly and respectfully. Please email your local studio with your name, a description of the issue, and your desired resolution.

B. Arbitration Agreement
By agreeing to these Terms, you consent to resolve all disputes through binding arbitration, governed by the Federal Arbitration Act and administered by JAMS or the American Arbitration Association (AAA).

C. Class Action Waiver
Disputes will be resolved individually, not on a class or collective basis. If this waiver is found unenforceable, the arbitration agreement will be void, and disputes will be resolved in court.

D. Definition of Dispute
"Dispute" includes any disagreement related to your relationship with Homebody Studios, excluding personal injury claims and issues related to lost, stolen, or damaged property.

III. Studio Usage Policies

A. Use of Facilities by Minors
Clients under 18 must register and participate with parental or guardian consent. The minimum age for participation is 16, requiring a parent or guardian to take class with them.

B. Reservations, Charges, Classes, and Gift Cards
Reservations require pre-purchased classes or series.
Gift cards are non-expiring but become non-refundable once applied.
Class prices may change; however, existing credits retain their value until expiration.
Unpaid balances may result in service suspension and collection fees.

C. Purchase Refund and Cancellation Policies

Credit Packages:
Refunds are available only if:

  • No classes (including waitlist) have been reserved, and

  • The request is submitted within 5 days of purchase.
    To request, contact your local studio.

Memberships:

  • Membership fees are non-refundable.

  • Memberships can be canceled at any time without penalty.

  • Submit cancellation requests to your local studio.

Membership Pauses (Recurring Memberships):

  • Pauses are allowed once per quarter for a minimum of 1 week, due to medical or travel needs.

  • Requests must be submitted in writing or via email to your local studio.

D. Class Attendance and Waitlists

  • If you are not present at the start of class, your spot may be given to a waitlisted client.

  • Treat the waitlist like a confirmed reservation: failure to remove yourself if unable to attend may result in a fee.

E. Class Cancellation Policy

  • Cancel at least 12 hours before class to avoid fees.

  • Late Cancel Fee: $15

  • No-Show Fee: $20

  • Fees may be waived in cases of illness or emergencies, but notification must be sent as soon as possible for consideration.

IV. Payment and Membership

A. Payment Methods
We accept Visa, MasterCard, Discover, and American Express. Cash payments are never accepted. Monthly memberships are subject to auto-renewal unless canceled.

B. Class Expirations
Class packages have expiration dates, which are clearly stated at the time of purchase. Expiration extensions are available upon request for extenuating circumstances.

C. Membership Cancellation
You may cancel your monthly membership at any time. Membership cancellations must be requested in writing via email 5 days before the next billing cycle.

V. Intellectual Property Rights

All content on the Homebody Studios website and branding are owned by Homebody Studios. Unauthorized use is prohibited.

VII. Privacy Compliance (California + Texas)

Homebody Studios complies with all relevant state privacy laws, including the California Consumer Privacy Act (CCPA). California residents have the right to:

  • Access, correct, or delete personal information.

  • Request disclosure of the personal data we collect and share.

  • Opt out of the sale of personal information (Note: we do not sell personal data).
