Terms and Conditions - Homebody Studios
I. Application of These Terms and Conditions (the “Homebody Agreement”)
This website is operated by Homebody Studios. These Terms and Conditions ("Terms") govern your relationship with Homebody Studios, including your use of the Homebody Studios Website, purchase of classes or memberships, rights to cancel, registration, merchandise purchases, communication with Homebody Studios, and use of the studio facilities. Homebody Studios includes Pilates classes and related wellness services.
II. Arbitration Agreement and Class Action Waiver
A. Informal Dispute Resolution
Homebody Studios values every client’s experience. If an issue arises, please contact us at austin@homebodystudios.co with your name, a description of the issue, and the desired resolution.
B. Arbitration Agreement
By accepting these Terms, you agree to resolve disputes through binding arbitration governed by the Federal Arbitration Act. Disputes will be handled by JAMS or the American Arbitration Association (AAA).
C. Class Action Waiver
Disputes will be handled individually and not on a class-wide basis. If the class action waiver is deemed unenforceable, arbitration will be void and the dispute will be settled in court.
D. Definition of Dispute
Disputes include any disagreement regarding your relationship with Homebody Studios, except for personal injury claims or lost, stolen, or damaged property.
III. Studio Usage Policies
A. Use of Facilities by Minors
Clients under 18 must register and participate with parental or guardian consent. The minimum age for participation is 16, requiring a parent or guardian to take class with them.
B. Reservations, Charges, Classes, and Gift Cards
Reservations require pre-purchased classes or series.
Gift cards are non-expiring but become non-refundable once applied.
Class prices may change; however, existing credits retain their value until expiration.
Unpaid balances may result in service suspension and collection fees.
C. Purchase Refund and Cancellation Policies
Credit Packages: Refunds are available only if no classes have been reserved (including waitlist reservations) and the refund request is made within five (5) days of the purchase date. Once a class has been used or the five-day period has elapsed, refunds are no longer eligible. Email austin@homebodystudios.co to do so.
Membership Purchases: Membership fees are non-refundable. However, memberships can be canceled at any time without penalty. Email austin@homebodystudios.co to do so.
Recurring Membership Pauses: Recurring memberships may be paused for medical or travel purposes, subject to the following conditions:
A pause can only occur once per quarter.
The pause must be for a minimum duration of one (1) week.
Requests to pause memberships must be submitted via email or in writing.
D. Class Attendance and Waitlist
If you are not present at the studio by the start time of class, your spot may be given to someone on the waitlist. Please allow yourself enough time to park and prepare for class.
Treat the waitlist with the same level of commitment as a class reservation. If you are unable to attend, you must remove yourself from the waitlist. Failure to do so will result in a late cancel or no-show fee if you are added to the class. This ensures fairness to other clients who intend to show up.
E. Class Reservation Cancellation Policy
Cancel at least 12 hours before class to avoid a fee.
The late cancel fee is $15, and the no-show fee is $20.
Waiver of Fees: Late cancel/no-show fees will only be waived in cases of sickness or emergencies, and the client must notify the studio as soon as possible for consideration.
IV. Payment and Membership
A. Payment Methods
We accept Visa, MasterCard, Discover, and American Express. Cash payments are never accepted. Monthly memberships are subject to auto-renewal unless canceled.
B. Class Expirations
Class packages have expiration dates, which are clearly stated at the time of purchase. Expiration extensions are available upon request for extenuating circumstances.
C. Membership Cancellation
You may cancel your monthly membership at any time. Membership cancellations must be requested in writing 5 days before the next billing cycle.
V. Intellectual Property Rights
All content on the Homebody Studios website and branding are owned by Homebody Studios. Unauthorized use is prohibited.
VI. Warranty Disclaimer and Limitation of Liability
Homebody Studios is not liable for any damages arising from the use of our website or services.
